Administrative Law

Administrative and public procurement lawyer in Brazil

I advise companies and public entities that deal with Brazilian government bodies, from bidding to contract performance.

Doing business with the Brazilian government comes with its own deadlines, formalities and rules. I help companies read tender documents, prepare bids and qualification papers, challenge requirements and file appeals, and manage contracts governed by Brazil’s Public Procurement Law (Lei 14.133/2021), including amendments, price rebalancing and penalties.

I also handle administrative proceedings, guided at the federal level by Lei 9.784/1999, and litigation against government acts. In addition, I work on projects with foreign governments and public entities, covering administrative law, contracts and regulation, and on matters before Brazilian regulatory agencies.

FAQ

Common questions

Can a foreign company bid in a Brazilian public tender?

In many cases, yes, though requirements vary by tender. Foreign bidders may need to present translated and legalized documents and appoint a local representative, and some tenders are international while others are domestic. Each notice should be read carefully, and we can do that together in a consultation.

Which law governs public procurement in Brazil today?

Lei 14.133/2021 is now the general framework for public tenders and government contracts, replacing the older statutes after a transition period. Contracts signed under the previous rules may remain governed by them until they end.

What happens if a public contract becomes unprofitable?

Brazilian law provides ways to restore a contract’s economic balance when significant unforeseen events change its costs. The request must be well supported with evidence, and the outcome depends on the contract and the facts.
